Terms of Service

The short version
- You buy credits up front. One credit makes one design, which is two images. Nothing is a subscription and nothing auto-renews.
- Credits never expire. They are not money, not a gift card, and cannot be cashed out.
- Unused credits can be refunded to the card you paid with. Credits you already spent cannot — the images were made and they cost real money to make.
- The designs you make are yours to use, including for your business. But AI images get no copyright protection in the US, so we cannot promise nobody else gets a similar one.
- This is one person, not a company. If something breaks, email support@nailmind.app and a human — me — will read it.
These are the rules for using NailMind. I have tried to write them the way I would explain them to you across a nail table, because terms nobody can read protect nobody.
1. Who you are dealing with
NailMind is run by Minh Pham, a sole proprietor based in Arkansas. There is no company, no office and no staff — one person builds it and answers the email. You can reach me at support@nailmind.app.
These terms apply when you use NailMind, whether or not you make an account. If you do not agree with them, please do not use the service.
2. Who can use it
You must be at least 13 years old to use NailMind, and at least 18 to buy credits. If you are between 13 and 18, you may use the free features with a parent or guardian's permission, but you may not make a purchase.
3. Your account
Your account is a phone number. There is no password. That keeps signing in fast, and it also means anyone who can receive texts at your number could reach your account. Please treat your number as the key it is.
Being straight with you: text-message verification is not switched on yet. Until it is, if an account holds credits or saved designs, I do not let it be signed into from a new device automatically — you have to email me so I can check it is really you. It is slower. It is also the only honest way to run it until verification is live.
One person, one account. Please do not make extra accounts to farm free designs — it takes the free tier away from someone who wanted to try the app.
4. What a credit is
One credit makes one design. A design is currently two images generated from your description. The number of images per design is set in the app and I may change it; the number you see at the time you spend the credit is the number that applies.
If part of a set fails to generate — one image comes back instead of two — the credit goes back to your balance automatically and you keep whatever did arrive.
Credits are not money, not a gift card, and not stored value. You cannot cash them out, transfer them to another person, or use them anywhere but NailMind.
Credits you paid for never expire. Free credits — the welcome credit, promotional credits, anything I hand out at the front desk — are a gift, are never refundable, and I may withdraw them if an account is being used abusively.
5. Prices and paying
Current prices:
- Starter pack — a one-time offer for new members, at the price and credit count shown on your paywall when it appears.
- 10 credits — $4.99
- 25 credits — $9.99
- 60 credits — $19.99
All prices are in US dollars. Payments are handled by Stripe. Your card details go to Stripe and never touch NailMind's servers — I never see your full card number.
The price shown at checkout is what your card is charged. If you are outside the United States, your bank may add its own foreign-transaction or currency-conversion fee, and depending on where you live, local sales tax or VAT may not be included in the price shown. Those charges are between you and your bank or your tax authority; I cannot see them or refund them.
I may change prices at any time. A change never affects credits you already bought.
6. Refunds
I would always rather refund you than have you feel stuck. Email support@nailmind.app with the phone number on the account and what happened.
How it actually works, so there are no surprises:
- Refunds are made one purchase at a time, back to the card you paid with. I cannot refund half a pack, and I cannot send the money anywhere else.
- When a purchase is refunded, credits are removed from your balance — up to the number that purchase contained, and never more than you currently hold. If you have already spent them all, you keep the images and I take the loss.
- Ask before you spend. Once credits are used, the images have been generated and paid for on my side, so used credits are not refundable.
- Card refunds have a time limit that comes from the card networks, not from me — roughly six months after the purchase. After that, the money cannot be sent back to the original card. If you are outside that window, email me anyway and I will find a fair answer.
If you are in the EU or UK, you have a statutory 14-day right to cancel a distance purchase. By buying credits and using one immediately, you are asking for the service to start straight away and you accept that the right to cancel is lost for credits you have already spent. Unused credits remain refundable as above.
7. What you may and may not ask for
Please do not use NailMind to generate:
- anything sexual, hateful, violent, or illegal;
- images of a real, identifiable person without their permission;
- anything designed to copy a specific artist's or brand's protected work in order to pass it off as theirs.
Do not try to break, overload, or reverse-engineer the service, and do not resell access to it. If an account is used this way I may suspend it. If I suspend an account for abuse, I will still refund unused credits that were paid for.
Your descriptions are also sent to Google to make the images, and Google applies its own safety filters. Sometimes a perfectly innocent request gets blocked by them. That is not a judgement about you, and if it costs you a credit, that credit comes back.
8. Who owns the designs
The designs you generate are yours. Use them personally, show them to your nail tech, post them, print them, use them for your salon's marketing — all fine, no extra licence needed, no royalty.
Two honest limits:
- Under current US law, images made purely by AI do not get copyright protection. That means I cannot promise the design is exclusively yours, and neither you nor I could stop someone else using a similar one.
- Someone else typing a similar description will get a similar design. There is no exclusivity built into the product.
I may keep a copy of designs saved to your account so the app can show them to you. I do not sell them, publish them, or use them to advertise NailMind without asking you first.
9. What I promise, and what I do not
NailMind is provided as is. I work hard on it, but I cannot promise:
- that an image will match what you pictured — AI does not work that way;
- that a design is achievable on your nails, at your length, by your tech, at any particular price. The app aims for salon-realistic results, but your nail technician's judgement always beats the picture;
- that the service is available without interruption. It depends on Google, Stripe and my web host, and any of them can have a bad day.
Nothing here takes away rights you have under the consumer law where you live.
10. If something goes wrong
If NailMind causes you a loss, the most I can owe you is what you paid me in the 12 months before it happened — or $50, whichever is greater. I am not liable for indirect losses like lost profits or lost bookings.
This is not me trying to escape responsibility for a bad charge. Billing problems get fixed and refunded. This clause is about the difference between a mistake and a lawsuit.
11. Closing your account
You can close your account at any time — email support@nailmind.app from any address and tell me the phone number on it. Because the number alone is not a secret, I will confirm it is really you before deleting anything.
Before you close it: if you have unused credits, ask for a refund first. Deleting the account removes the balance along with everything else, and once it is gone there is nothing left to refund against.
I may close an account that is being used to break these terms. If I close yours and you had paid credits left, I will refund them.
12. If NailMind shuts down
If I ever stop running NailMind, I will give at least 30 days notice at nailmind.app and refund unused paid credits wherever the card networks still allow it. Please download any designs you want to keep — they will not outlive the service.
13. Changes to these terms
I may update these terms. The version number and date at the top always tell you which one is current. If a change materially affects what you have already bought, I will say so on the site rather than change it quietly.
14. Which law applies
These terms are governed by the laws of the State of Arkansas, USA, and any dispute belongs in the state or federal courts there. If you are a consumer somewhere else, this does not take away the protections your local law gives you or your right to bring a claim where you live.
